Understanding Premises Liability Law in Minnesota

The "premises liability doctrine" holds property owners and occupiers accountable when hazardous conditions on their property lead to injuries. These cases hinge on the legal responsibility of property owners to keep their premises reasonably safe for visitors. Under Minnesota law outlined in Minnesota Statutes Chapter 327, Section 60E.02, property owners owe a duty of care to those legally on their property, including patrons, tenants, and guests. This duty means fixing or addressing unsafe conditions such as wet floors, broken stairs, or failing to secure hazardous areas. When this responsibility is breached, resulting in injuries, the property's owner or a responsible party may be held liable for damages.

Premises liability cases cover a wide range of situations, including:

  • Slips and falls caused by wet floors, icy sidewalks, or uneven surfaces.
  • Negligent security leading to injuries from assaults due to inadequate lighting or unlocked entrances.
  • Defective conditions, such as broken railings or hazardous materials.
  • Dog bites and other animal-induced incidents, such as severe scratching, clawing, or other serious harm.

However, these cases can depend on factors like the injured party's legal status on the property and whether the owner exercised reasonable care. Those who trespass on a property and become injured in doing so are usually not owed a duty of care, and likewise, those who are injured despite a property owner taking reasonable precautions to prevent it may also have difficulty recovering damages.

Common Premises Liability Cases and Next Steps

If you’re a victim of a premises liability injury, you may be entitled to recover compensation for damages you have suffered. Each case is different, and this means fair and just compensation can vary widely as well. However, in many cases, you may be eligible to receive compensation for at least some of the following:

    • Medical expenses, including both immediate and long-term treatments and pain management.
    • Lost wages due to missed work, both in the immediate term and potentially for diminished earning potential.
    • Pain and suffering, which can radically diminish your quality of life.
    • Future rehabilitation costs, including accommodation requirements or change in lifestyle costs.

In rare cases, you might also be able to petition the court for punitive damages. Punitive damages are extra financial compensation that is used as an additional punishment or penalty levied against property owners who acted with extreme negligence, including those who willfully acted negligently or knowingly put the injured party at risk. These damages are awarded on top of compensation for the damages already sustained, but they also require being able to definitively demonstrate that the property owner or responsible party acted with malicious intent or in a way that was grossly careless.

To strengthen your case, it’s important to document your injuries, take photos of the hazardous conditions, and gather witness statements immediately after the incident. It is also important to continuously document your recovery and all visits with medical professionals, as this will provide a lot of insight into your life's long-term outlook.
