Uber/Lyft Accidents in Minneapolis

Serving Clients Throughout Minnesota

At Butwinick Injury Law, we understand the unique challenges and complexities involved in Uber and Lyft accident cases. As ridesharing services have become increasingly popular, accidents involving these vehicles have also risen, presenting unique legal issues compared to traditional auto accidents.

The Dangers of Uber

Uber rides can pose unexpected risks for passengers, pedestrians, and other drivers. Accidents involving Uber vehicles can be complex due to multiple responsible parties, including the driver, Uber, and various insurance providers. Many Uber drivers work long hours, increasing the risk of fatigue-related accidents. Additionally, background checks may not always prevent unsafe drivers from operating on the platform.

If you’re involved in an accident with an Uber vehicle—whether as a passenger, another driver, a pedestrian, or a cyclist—navigating the claims process can be challenging. Butwinick Injury Law is here to help you understand your rights and pursue the compensation you deserve.

Common Causes of Rideshare Accidents

Uber and Lyft accidents can occur for many of the same reasons as other auto accidents, including:

  • Distracted driving
  • Speeding
  • Reckless driving
  • Fatigue
  • Poor vehicle maintenance
  • Inexperienced or poorly trained drivers

Insurance Issues Associated With Uber Accidents

Uber accidents involve complex insurance issues because multiple policies may come into play, depending on the driver’s status at the time of the crash. Unlike standard car accidents, Uber drivers are considered independent contractors, which can make liability and coverage disputes more difficult to resolve.

Uber’s insurance coverage is divided into three phases:

    • Offline: If the driver is not logged into the Uber app, their personal auto insurance applies. Uber provides no coverage in this case.
    • Available but No Ride Accepted: If the driver is logged into the app but has not yet accepted a ride, Uber provides limited liability coverage, including up to $50,000 per person and $100,000 per accident for injuries, plus $25,000 for property damage.
    • Ride Accepted or Passenger on Board: Once a driver has accepted a ride request or has a passenger in the vehicle, Uber’s $1 million liability policy applies, covering injuries and property damage.

While Uber does provide significant insurance coverage, making a claim is not always straightforward. Insurance companies may attempt to deny responsibility or minimize payouts, leaving victims struggling to cover medical expenses, lost wages, and other damages. Additionally, if another driver was involved in the accident, determining fault and which insurance policy applies can further complicate the claims process.

If you’ve been injured in an Uber accident, Butwinick Injury Law is here to help. Our team understands the complexities of rideshare insurance claims and will fight to ensure you receive the full compensation you deserve.
